Terms & conditions

Scope

The following general terms and conditions (GTC) apply to all sales and other services that are concluded between the seller, Mag. Mirja Rutger, and the customer. Deviating agreements must be in writing. By submitting an order, the customer agrees to these terms and conditions and is bound by them. A customer is within these terms and conditions defined as any natural person who concludes a legal transaction for a purpose that can largely not be attributed to their commercial or independent professional activity.

If individual clauses of these terms and conditions should be wholly or partially ineffective due to mandatory statutory provisions (in particular the provisions of the consumer protection law), the remaining provisions of these terms and conditions remain effective.

Offers

The seller reserves the right to change the content/offers of the respective service at any time. The articles in the online shop are not a legally binding offer on the part of the seller, but rather an invitation to the customer to place an order.

All products in the online shop are handmade and therefore unique pieces. It can therefore happen that the product that the customer receives shows slight deviations from the product shown in the online shop. This does not constitute a reason for complaint. 

All offers are valid while stocks last. All errors excepted.

Ordering process  & Conclusion of contract

1. By adding offered products to the cart by clicking the “Add to basket” button of the webshop the customer can make non-binding choices.

2. The customer can proceed to complete the order process by using the “Checkout” button in the shopping cart area of the webshop. Before completing the order the customer can review and change the content of the shopping cart.

3. By clicking the “Checkout” button the customer makes a binding offer to purchase the item(s) in the shopping basket of the webshop. After pressing the “Place order” button, the consumer enters into a legally binding contract with the seller.

4. The contract is concluded when the seller accepts the order by sending an order confirmation by email.

5. Ordered goods will be sent once payment has been received.

Contract languages

The content of the contract and all other information are offered consistently in English. Customer service and complaint handling by direct email or telephone contact are offered in English, German and Swedish.

Prices

Prices for goods in the webshop are due to the seller’s legal status as a small business owner VAT-exempt. Therefore, all product prices do not include value added tax.

Shipping costs are added to the sales price and displayed during the ordering process.

Payment

The customer can choose from the following payment options during the checkout process and before placing an order:

– Credit card

– Bank transfer

– PayPal 

When paying by bank transfer, the customer must make the payment immediately after completing the order. 

If payment of the order is processed by third-party providers such as PayPal, their general terms and conditions also apply.

In the event of a delay in payment, the customer is obliged to reimburse all reminder and collection expenses incurred by the seller due to this delay in payment for the appropriate legal prosecution. The seller reserves the right to claim higher damage caused by delay.

The order will only be dispatched or processed after receipt of payment.

Retention of title

The products remain the property of the seller until full payment has been made.

Warranty

The warranty is governed by the statutory regulations.

A guarantee for sold goods only apply if clearly stated by the seller.

Risk of loss or damage during delivery

Sold goods are generally sent by using tracked services. 

When the goods are dispatched, the risk of loss or damage to the goods only passes to the customer as soon as the goods are delivered to the customer or to a third party determined by the customer and different from the carrier. However, if the customer him/herself has concluded the contract of carriage without using any of the options proposed by us, the risk passes to the carrier as soon as the goods are handed over.

Withdrawal

You have the right to cancel the contract within 14 days of receiving purchased goods without giving a reason and return the purchased goods. Products that are produced in agreement between the seller and the customer to in advance agreed specifications or tailored to personal needs are exempted from these terms.

Withdrawal can be made within the 14-day period by contacting us through the email address in the imprint.

In the event of withdrawal, the purchase price will only be reimbursed once the goods has been returned to the seller. Both the return of the goods and reimbursement of the purchase price must be made within 14 days of the declaration of withdrawal or return of the goods. The terms are that the goods are in an unused and new resalable condition. The customer will carry the costs of the return.
